Terms of Usage

Article 1 (Definitions)

"Cast" refers to any individual involved in the operation of Imagination Server.
"Guest" refers to any individual or organization who uses or participates in The Services provided by Imagination Server.
"These Terms" refers to the Terms of Use of Imagination Server.
"The Service" refers to the virtual theme park experience provided by Imagination Server to Guests. Further details are set forth in Article 4, Paragraph 2.
"Skin" refers to the visual appearance of a player or NPC avatar within Minecraft, including images, illustrations, or the appearance itself used to modify that representation.
"Command" refers to text-based instructions or control mechanisms used to execute advanced operations within Minecraft.
"Texture" refers to images, illustrations, or the appearance itself that modify the visual display of items within Minecraft.

Article 2 (Agreement to These Terms)

1. Guests shall be able to use or access The Service provided by Imagination Server only upon agreeing to These Terms.

By using or accessing any part of The Service, the Guest is deemed to have agreed to These Terms.

2. Since The Service relies on platforms such as Minecraft and Discord, provided by Microsoft Corporation, Mojang Studios, and Discord Inc., agreement to These Terms also requires agreement to the “Minecraft End User License Agreement” provided by Mojang Studios and “Discord’s Terms of Service” provided by Discord Inc.

In accordance with Article 8 of These Terms, Imagination Server assumes no responsibility for any issues arising on such platforms, and all responsibility lies solely with the Guest.

If you do not agree to These Terms, or if you violate them, Imagination Server reserves the right to deny you access to or use of The Service.

Article 3 (Amendments to These Terms)

1. These Terms may be amended by Imagination Server at any time without prior notice to, or consent from, the Guest. By continuing to use The Service, the Guest is deemed to accept such amendments without objection. Amendments to These Terms may also be made based not only on the discretion of Imagination Server, but also in response to the decisions, requests, or policies of the following companies and organizations:

  • Microsoft Corporation
  • Mojang Studios
  • Discord Inc.
  • The Walt Disney Company
  • Walt Disney Attractions Japan
  • The Walt Disney Imagineering
  • Oriental Land Co., Ltd.

2. By using The Service after any amendment to These Terms, the Guest is deemed to have agreed to the revised Terms.

Article 4 (Provision, Content, and Scope of The Service)

1. Imagination Server provides The Service on a non-profit basis in accordance with Article 38, Paragraph 1 of the Copyright Act of Japan ("Performances, etc. not for profit-making purposes")

2. “The Service” as defined in These Terms refers to the virtual theme park experience provided by Imagination Server under the concept of “To The Happiest Place. Anytime, Anywhere.” This includes participation in Minecraft worlds created and published by Imagination Server, participation in Discord servers managed and published by Imagination Server, and participation in other media or events created, published, or conducted by Imagination Server. Services not listed above are not considered official services of Imagination Server.

3. Guests are responsible for preparing, at their own expense and risk, the necessary devices, software, and internet connection required to access The Service. Imagination Server shall not be liable in any way if the Guest is unable to use The Service due to issues with such equipment or connections.

4. Imagination Server reserves the right to change any or all aspects of The Service at any time without prior notice if deemed necessary.

5. Imagination Server may suspend or terminate The Service without prior notice if it determines that continued operation is no longer commercially or operationally viable.

Article 5 (Rights)

All copyrights and intellectual property rights related to the Imagination Server website on which These Terms are posted, as well as any videos, images, text, or other content published by Imagination Server and all aspects pertaining to The Service, are vested in Imagination Server or their respective legitimate rights holders. Agreement to These Terms does not constitute a license or grant of any right to use any copyrights or intellectual property owned by Imagination Server.

Furthermore, no distribution of any works related to the Imagination Server website, content published by Imagination Server, or The Service shall be permitted.

The allocation of specific intellectual property rights is described below. However, unless explicitly stated otherwise, all copyrights and intellectual property rights related to the Imagination Server website, content published by Imagination Server, and The Service shall belong to Imagination Server or the legitimate rights holders, as described above.

1. Name and Logo

All copyrights and intellectual property rights to the organization name "Imagination Server" and its logo are owned exclusively by Imagination Server.

2. World Content

(1) In-World Objects

All blocks, 3D models, textures, and other elements placed within the world by Imagination Server (hereinafter referred to as "In-World Data") are considered reproductions of the buildings located in Maihama, Urayasu City, Chiba Prefecture—specifically those of "Tokyo Disney Resort"—and are treated as "artistic works permanently installed in an open place" or "architectural works" in accordance with Article 46 of the Copyright Act of Japan ("Exploitation of an artistic work, etc. located in open places"). The Service does not engage in "reproduction of an artistic work exclusively for the purpose of selling its reproductions" nor does it "offer such reproductions to the public by transferring ownership of them," both of which are acts prohibited under the aforementioned Article. Rather, The Service is provided as a non-profit "performance" in accordance with Article 38, Paragraph 1 of the Copyright Act of Japan ("Performances, etc. not for profit-making purposes"), as stated in Article 4, Paragraph 1 of These Terms. Therefore, all copyrights and other intellectual property rights to the In-World Data created by Imagination Server are owned by Imagination Server. Any reproduction, modification, or distribution of the In-World Data to third parties beyond the scope of personal use without express written permission from Imagination Server is strictly prohibited, as are any other acts that may infringe upon the copyrights or intellectual property rights related to the In-World Data.

As stated in this provision,

All blocks, 3D models, textures, and other elements placed within the world by Imagination Server (hereinafter referred to as "In-World Data") are considered reproductions of the buildings located in Maihama, Urayasu City, Chiba Prefecture—specifically those of "Tokyo Disney Resort"—and are treated as "artistic works permanently installed in an open place" or "architectural works" in accordance with Article 46 of the Copyright Act of Japan ("Exploitation of an artistic work, etc. located in open places"). The Service does not engage in "reproduction of an artistic work exclusively for the purpose of selling its reproductions" nor does it "offer such reproductions to the public by transferring ownership of them," both of which are acts prohibited under the aforementioned Article. Rather, The Service is provided as a non-profit "performance" in accordance with Article 38, Paragraph 1 of the Copyright Act of Japan ("Performances, etc. not for profit-making purposes"), as stated in Article 4, Paragraph 1 of These Terms.

Under the same interpretation as described above, Imagination Server does not hold rights to the intellectual property of others or other organizations' works that it creates or reproduces. However, clear imitation of such works would be considered an infringement of rights.

Examples:

A user recreates “Tokyo Disneyland” by mimicking the architectural works of “Tokyo Disneyland” and placing blocks and 3D models within their own world, then claiming the world as their original creation and publishing it.

→ This does not infringe on Imagination Server's rights.

A user recreates “Tokyo Disneyland” by mimicking the In-World Data of “Imagination Server” and placing blocks and 3D models within their own world, then claiming the world as their original creation and publishing it.

→ Placing in their own world does not infringe upon Imagination Server's rights. However, claiming it as their original creation and publishing it is an infringement of Imagination Server's rights, regardless of the statement of authorship.

A user recreates “Imagination Server” by mimicking the In-World Data of “Imagination Server” and placing blocks and 3D models within their own world, then claiming the world as their original creation and publishing it.

→ Placing in their own world does not infringe upon Imagination Server's rights. However, claiming it as their original creation and publishing it is an infringement of Imagination Server's rights, regardless of the statement of authorship.

Please note that in all of the above examples, it is possible that such actions may infringe upon the intellectual property rights of third parties, separate from those belonging to Imagination Server.

(2) Skins, NPCs, etc.

The copyright for any Skin created and used by a Cast member individually belongs to the creator of that Skin. Therefore, any act of reproduction, modification, or redistribution of such Skins without express permission from the creator is strictly prohibited.

All Skins and NPCs used within Imagination Server, except those individually created by Cast members themselves, are owned by Imagination Server, including all associated copyrights and intellectual property rights. Therefore, any act of reproduction, modification, or redistribution of these without express permission from Imagination Server, as well as any other acts that may infringe upon Imagination Server's copyrights and intellectual property, is strictly prohibited.

Certain Skins and NPCs are provided as "Performances" for non-profit purposes in accordance with Article 38, Paragraph 1 of the Copyright Act of Japan ("Performances, etc. not for profit-making purposes"), as stated in Article 4, Paragraph 1 of These Terms. However, their use may be subject to modification based on requests from the following companies or organizations:

  • Microsoft Corporation
  • Mojang Studios
  • The Walt Disney Company
  • Disney Parks, Experiences and Products
  • The Walt Disney Imagineering
  • Oriental Land Co., Ltd.

(3) Musics

With the exception of music provided by Minecraft, all music used by Imagination Server is provided as "Performances" for non-profit purposes in accordance with Article 38, Paragraph 1 of the Copyright Act of Japan ("Performances, etc. not for profit-making purposes"), as stated in Article 4, Paragraph 1 of These Terms. However, the use of such music may be subject to modification based on requests from the following companies or organizations:

  • The Walt Disney Company
  • Walt Disney Attractions Japan
  • The Walt Disney Imagineering
  • Oriental Land Co., Ltd.

(4) Commands

Imagination Server does not assert ownership of any rights over the Commands it creates and uses, in accordance with the "Minecraft End User License Agreement."

(5) Textures

With the exception of Textures provided by Minecraft, all copyrights and intellectual property rights for Textures created and used by Imagination Server belong exclusively to Imagination Server.

Certain Textures are provided as "Performances" for non-profit purposes in accordance with Article 38, Paragraph 1 of the Copyright Act of Japan ("Performances, etc. not for profit-making purposes"), as stated in Article 4, Paragraph 1 of These Terms. However, their use may be subject to modification based on requests from the following companies or organizations:

  • Microsoft Corporation
  • Mojang Studios
  • The Walt Disney Company
  • Disney Parks, Experiences and Products
  • The Walt Disney Imagineering
  • Oriental Land Co., Ltd.

3. Images, Videos, and 3D Data

All copyrights and intellectual property rights for images, videos, and 3D data published by Cast members of Imagination Server on officially recognized media—such as Imagination Server's official social media accounts (including but not limited to X, Instagram, TikTok, and Discord), the official Imagination Server website, and the official Imagination Server YouTube channel—as referenced in Article 5, Paragraph 4 of These Terms, are vested in either Imagination Server or the individual Cast member who created and posted the content.

Therefore, any act of reproduction, modification, or redistribution of these without permission from Imagination Server, as well as any other acts of infringement on Imagination Server's copyrights and intellectual property, is prohibited.

4. Official SNS, Website, YouTube, etc.

Only media platforms expressly recognized as official by Imagination Server—such as Imagination Server's official social media accounts (including but not limited to X, Instagram, TikTok, and Discord), the official Imagination Server website, and the official Imagination Server YouTube channel—are authorized to disseminate official information on behalf of Imagination Server. Therefore, any posts related to Imagination Server made through accounts or media platforms not officially recognized by Imagination Server do not represent the official views or positions of Imagination Server.

Furthermore, all rights to all content—including but not limited to text, images, and videos—posted on accounts and media platforms officially recognized by Imagination Server are owned exclusively by Imagination Server. Therefore, as stated in Article 5, Paragraph 3 of These Terms, any act of reproduction, modification, or redistribution of these without permission from Imagination Server, as well as any other acts of infringement on Imagination Server's copyrights and intellectual property, is prohibited.

5. Projects

All rights to projects offered through The Service, including but not limited to their names, concepts, and content, are owned exclusively by Imagination Server. However, general or abstract concepts inspired by social events, cultural phenomena, or common practices are not subject to such exclusive ownership.

Article 6 (Prohibited Conduct)

Guests shall not engage in any of the following acts in connection with the use of The Service, nor in any acts that Imagination Server deems to fall under any of the following categories. In the event that a Guest engages in such conduct or is deemed by Imagination Server to have engaged in such conduct, the Guest may be prohibited from participating in The Service.

1. Acts that violate laws and regulations, or acts related to criminal conduct.

2. Acts of fraud or intimidation directed at Imagination Server’s Cast members, other Guests, or any third party.

3. The following acts within the World of Imagination Server:

(1). Intentional entry into restricted areas.

(2). Intentional destruction or alteration of In-World Data.

(3). Offensive behavior or remarks, discriminatory or insulting language directed at others, or any conduct contrary to public order and morals.

(4). Disclosure of another person’s personal information without their consent.

(5). Excessive self-promotion.

(6). Intentional overloading of the Server.

(7). Persistent and unsolicited communication with Cast members.

(8). Falsely impersonating a Cast member.

(9). Use of external tools that Imagination Server deems disruptive to Server operations.

(10). Use of low-visibility Skins or Skins deemed inappropriate by Imagination Server.

(11). Conduct that interferes with the experiences of other Guests.

(12). Failure to comply with instructions issued by Imagination Server’s Cast members.

(13). Acts that violate the “Minecraft End User License Agreement” or other usage agreements established by Mojang Studios or the companies that provide Minecraft.

(14). Any other acts that impede the smooth operation of the Server.

4. The following acts within the official Imagination Server Discord:

(1). Offensive remarks, discriminatory or insulting statements directed at others, or any conduct contrary to public order and morals.

(2). Disclosure of another person’s personal information without their consent.

(3). Excessive self-promotion.

(4). Persistent and unsolicited communication with Cast members.

(5). Falsely impersonating a Cast member.

(6). Conduct that interferes with the experiences of other Guests.

(7). Failure to comply with instructions issued by Imagination Server’s Cast members.

(8). Acts that violate the “Discord's Terms of Service” or other usage agreements established by Discord Inc.

(9). Any other acts that impede the smooth operation of the Server.

5. The following acts on web services operated by Imagination Server:

(1). Reverse assembly, reverse compilation, or reverse engineering of source code, systems, etc. of Imagination Server's services

(2). Using The Services by means of another person’s authentication credentials.

(3). Acts such as excessive access that disrupt the operation of The Services.

(4). Any other acts that Imagination Server deems inappropriate.

6. Acts that infringe upon the rights set forth in Article 5 of These Terms, or that infringe upon the rights of Imagination Server, Cast members, Guests, or any other third parties.

7. Failure to comply with instructions issued by Imagination Server’s Cast members.

8. Any other acts that hinder the provision of The Service by Imagination Server.

Article 7 (Guest Streaming, Video and Image Posting)

1. Guests may stream, post videos, or post images such as screenshots of The Service on the internet only when such content pertains exclusively to the World content within Minecraft that has been created and published by Imagination Server. Accordingly, Guests are strictly prohibited from publishing any content unrelated to Minecraft—such as chat interactions within Discord—on the internet, regardless of the form or medium.

2. Within the scope defined in Paragraph 1 of this Article, Guests may stream or post videos and images they have captured; however, when doing so, they must clearly indicate that the content was recorded within Imagination Server, using methods such as the following examples.

  • Posting images or videos of your experience in the World using hashtags recommended by Imagination Server, such as “#イマサバ” or “#イマサバ観光”, or by including terms such as “Imagination Server” or “イマサバ”.
  • Use a title that includes terms such as “Imagination Server” or “イマサバ,” and ensure that hashtags recommended by Imagination Server such as “#イマサバ”, “#イマサバ観光” or terms such as “Imagination Server” or “イマサバ” are included in a section where descriptive details of the stream or video—such as the description box.

Please note that the Guest shall bear full responsibility for any damages arising from such streaming or posting, including any copyright infringement contained within the content.

In particular, music used in the World within Minecraft may be subject to copyright infringement by the Guest who streams or posts such content. When distributing content that includes such music, Guests must manage such content at their own discretion and risk.

3. If a Guest intends to generate revenue through streaming, video posting, or image posting related to The Service, prior permission must be obtained from Imagination Server. Those wishing to monetize such content must contact Imagination Server through its official website.

4. If any posted stream, video, or image is found to be in violation of These Terms, or is deemed by Imagination Server to be in violation thereof, the person who posted the content may be requested to delete the relevant material.

5. The provisions above shall not apply to publication or reporting by press or media organizations, provided prior permission has been granted by Imagination Server. Additionally, individuals may post non-commercial content for the purpose of citation without obtaining prior permission, provided that it is explicitly stated that the content is a work produced by Imagination Server.

Article 8 (Liability)

Except in cases of willful misconduct or gross negligence on the part of Imagination Server, Imagination Server shall not be held liable for any damages incurred by a Guest.

Furthermore, in the event of a violation of These Terms, or if Imagination Server determines that a violation has occurred, all liability shall lie solely with the person who committed the violation, and Imagination Server shall bear no responsibility whatsoever.

In addition, Imagination Server shall not be held liable for any disputes arising between Guests, or between a Guest and a third party, in connection with this project.

Article 9 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan.

In addition, any disputes arising out of or in connection with The Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the representative of Imagination Server.

Privacy Policy

Imagination Server takes the utmost care to protect Guests' personal information. The policy stated below applies to personal information collected through Imagination Server's website and other activities related to The Service conducted by Imagination Server on the internet.

In the operation of The Service (including the operation of the Imagination Server website and Discord server; the same shall apply hereinafter), Imagination Server respects Guests' privacy and handles personal information (name, date of birth, email address, and other descriptions that can identify a specific individual) obtained through the operation of The Service in accordance with the following policy:

1. Imagination Server shall comply with the Personal Information Protection Act and various guidelines established by government agencies, continuously review and improve this Privacy Policy, and strive to ensure that its members and related external members comply with these policies.

2. All personal information provided to Imagination Server through the operation of The Service shall be used within the scope of the following purposes:

Imagination Server will use personal information obtained in relation to the operation of The Service for the provision of services and notification of various information in activities related to The Service.

1. Information entered by the Guest themselves, such as name, date of birth, email address, etc.

2. Image information contained in photographs provided by the Guest

3. Usage history of The Service (including location information) and purchase history of products, etc.

4. Usage and browsing history of the Imagination Server website, etc.

5. Information provided in response to surveys from Imagination Server

Imagination Server will analyze items 1-5 provided by Guests and use them for the following purposes:

(i). For advertising, promotion, and email distribution of services according to the Guest's interests and preferences

(ii). For improving products and services, and developing new products, services, and facilities

(iii). For advertising and promotion in Imagination Server's recruitment activities

The items of personal information provided by Imagination Server to third parties and the method of provision are as follows:

  • Information entered by the Guest themselves, such as name, date of birth, email address, etc.
  • Image information contained in photographs provided by the Guest
  • Usage history of The Service (including location information) and purchase history of products, etc.
  • Browsing history of the Imagination Server website, etc.

Regarding the scope of responsibility for the Privacy Policy on the official website, etc.

Imagination Server considers it extremely important to ensure the security of all information that can identify individual Guests and takes the utmost care when receiving personal information sent from Guests' computers and mobile devices to the web servers used by Imagination Server. However, please understand that despite our best efforts, no security measures for information provided via the internet can be perfect or completely free from leakage.

Imagination Server cannot guarantee the security of information that Guests transmit at their own responsibility or information received through online services.

By using The Service, the Imagination Server website, etc., Guests are deemed to have agreed to Imagination Server's Privacy Policy. If you do not agree with this Privacy Policy, please refrain from using The Service, etc.
